Amended version of the Law of Prohibition of Discrimination in Products and Services and in Entry to Entertainment Establishments and Public Facilities, 5761-2002. Under the amendment enacted in April 2011, it shall be deemed discrimination to withhold the supply of a product or a public service or prevent entry to a public establishment of someone included in the groups defined by law, if they were not withheld under the same circumstances for another group (Laws and Regulations).

Published:  Aviation Bill, 5770-2010. The bill was proposed to lay down a comprehensive and effective legal foundation for regulating all areas and aspects of civil aviation in Israel. It is also meant to create a base for the adoption of all the arrangements set out in the annexes to the Chicago Convention and the Aviation Regulations by way of a secondary legislation to be determined by the Ministry of Transport and Road Safety, granting necessary powers to the civil aviation authority and providing effective enforcement tools .

Added: Full text of the Independence Hall Law, 5769-2009, which provides for the conservation and construction of a museum in Independence Hall, including a commemoration of the life and works of Meir Dizengoff, Tel-Aviv first mayor. Added: Reference of a decision of the Nazareth Magistrate's Court of February 27, 2008, which denied an application for a temporary injunction prohibiting ski instructors from giving private lessons at the Mt. Hermon ski site. The court took into account the lack of proof of proprietary rights, the importance to be attached to the ski instructors' freedom of occupation, the risk of a monopoly of the Mt. Hermon ski site on the instruction of the skiers, and the consideration of the balance of convenience (Tourist Sites).

Under these regulations, certain classes of arrangements among airlines are exempt from having to be approved by the Antitrust Court. The regulations are in effect for five years (Aviation) .

Added: Judgment of the Netanya Magistrate Court dated June 22, 2008, rejecting a claim filed by a celebrations hall for payment of agreed compensation because the wedding was called off. The court held that having a business license for a celebrations hall is a suspending condition for the fulfillment of a contract. In Memoriam to the Hon. Judge Gad Engel of the Haifa Magistrates Court, who passed away today, added: Judgment of the Haifa Small Claims Court (the Late Hon. Judge Gad Engel), which rejected a claim of a young Arab Christian against El Al, claiming to have received discriminatory treatment in the airport security checks (Aviation - Judgments) .

Added: Judgment of the Jerusalem Small Claims Court (Hon. Justice A. N. Tennenbaum ) of March 28, 2008, which held that reporting to Iberia Airlines on the non-arrival of a suitcase is sufficient notice under Article 26 of the Warsaw Convention. The ruling maintained that the amount of compensation should be set according to the SDR (special drawing rights) conversion rate. It was also held that as prescribed in Air Transport Order (Special Drawing Rights), 1978 the inscription on the air ticket that compensation is $20/kg should be disregarded (Aviation - Judgments - Warsaw Convention - Article 26) .

Added: Judgment of the Tel-Aviv Magistrates Court of November 5, 2005 (before Hon. Justice Rahamim Cohen) concerning lack of privity between an Israeli car rental company through which a car rental transaction in Germany was entered into and an Israeli lessee.   The court held that there is privity of contract between the car rental company and the Israeli lessee, and that the Israeli company was obligated to disclose to the plaintiffs that there was no spare tire in the car they rented. Added: Judgment of the Magistrates Court in the Krayot of March 1, 2006 (before Hon. Justice Ayelet Dagan) concerning the duty of a travel agent and supplier of vacation packages to special-needs passengers (handicapped in wheelchairs). It was held that in the specific case of a passenger with mobility difficulties, the supplier has a "minimum duty of care to verify (even by phone) that the hotel is geared to accommodate the plaintiff with her specific handicap and that all the facilities needed function. This duty is easy to carry out and no unreasonable costs are involved. Added: Judgment of the Netanya Magistrates Court (Deputy Chief Justice Daphna Blatman-Kadrai) of January 14, 2008, requiring El-Al to compensate passengers, who agreed to the request of El-Al crew to carry through medical instrumentation for a terminally ill child, when it turned out during a customs check that it was musical equipment. The court is considering the liability of El All for its negligence towards its passengers, and held that in the circumstances the Warsaw Convention does not apply .

Added: Judgment of the Jerusalem District Court sitting as a court of administrative affairs on December 5, 2007. The judgment allowed a petition against the Ministry of the Interior in severely criticizing the Interior Ministry's conduct. Added:  Judgment of the Supreme Court sitting as the High Court of Justice dated May 2, 2005, dismissing a petition of senior executives in Israel Aircraft Industries, El Al and Bezeq against a Labor Tribunal judgment rejecting their claim for a 33% wage increase (Aviation - Judgments - Employment Conditions) .

The checkpoints to Israel were revised in the wake of the disengagement from Gaza under the Entry to Israel (Checkpoints) (Amendment) Order, 5765-2005 published on September 28, 2005. The order announced the following new border crossings: Erez Crossing, Kerem Shalom Crossing, Sufa Crossing and the Karni Crossing (Entry to Israel – Entry to Israel Arrangements).

The Entry to Israel Regulations were amended in accordance with the Entry to Israel Regulations (Amendment) Regulations, 5765-2005, which was published on September 28, 2005 and omitted the article: "A retroactive extension of permits of all types to stay in Israel after at least three months have passed from permit expiration date", from the list of paid services offered by the Ministry of the Interior (Entry to Israel - Entry to Israel Regulations).

Added:  Supreme Court decision concerning method of calculating tax breaks for a hotel ("Princess") in Eilat. The hotel demanded to be allowed to deduct depreciation from the actual price. The Supreme Court accepted the hotel’s position, providing that: "The company in being eligible for extra depreciation may deduct extra depreciation based on the original price according to its value in real terms. In addition… This extra depreciation shall be calculated at the rates prescribed in the inflation regulations…” (Hotels – Miscellaneous)

Added: Shipping Bill (Violations Against International Maritime Safety and Marine Facilities), 5765-2005. The bill is meant to put into effect in Israeli Law the 1988 Rome Convention for the Suppression of Unlawful Acts Against the Safety of Maritime Navigation as well as the provisions of the Protocol for the Suppression of Unlawful Acts Against the Safety of Fixed Platforms on the Continental Shelf. Adopting the provisions of the Rome Convention and the protocol in Israeli law will enable Israel to join the convention and the protocol and take part in the international war on terror at the international maritime level. Added: Decision of Tel-Aviv District Court on May 22, 2005 (Judge Varda Alshekh) within the framework of liquidation proceedings of the Geographic Tours Company Ltd. (in liquidation), providing that monies of the fund for securing money of customers who are members of the Israeli Association of Travel and Tourist Agents Ltd., which was established pursuant to the Tourism Services Law, 5736-1976, are not part of the liquidation assets, and the fund has the authority to divide the monies in accordance with the articles of the fund.  Special procedural provisions were also set forth regarding the filing of debt claims by customers to receive fund monies (Travel Agencies - Judgments) .

Added: Judgment of the Magistrates Court in Petah-Tikva on June 6, 2005 regarding the drowning of a child in a hotel swimming pool. The child was left by his father in the swimming pool and drowned within a short time. The court considered the obligations imposed on the party in possession of a swimming pool and the liability of the lifeguard, and it also considered the issue of the father's vicarious and contributory liability for the drowning. In the category of marketing travel services over the Internet, a citation was added of a decision of the Jerusalem District Court on December 18, 2003 regarding the local jurisdiction in a claim about copyright infringement on the Internet (Travel Agencies – Judgments).

In the category of duties of disclosure imposed on a vehicle vendor, we have added a judgment of the Haifa Magistrates Court dated March 28, 2005 (Judge A. Ganon) (Transportation).

Added: Judgment of the Tel-Aviv District Court dated February 7, 2005, which accepted an administrative petition filed by the Israeli Aerobatic Association against the Airports Authority in Israel. In the judgment the Airports Authority is ordered to disclose contracts that it made with El-Al in connection with the commercial terms between them (Airports - Judgments) .

Added: Judgment of the Rishon Lezion Magistrates Court dated February 28, 2005 (Judge S. Manheim) dismissing the claim of a hotel guest who sued for compensation due to the theft of a laptop from the hotel. The judge determined that the laptop is considered a "valuable" to which the special arrangement set forth in section 12(c) of the Watchmen Law applies (Hotels - Miscellaneous) .

Added: Supreme Court judgment dated April 22, 2004, dismissing a petition of Africa-Israel Hotels and other hotels in Tel-Aviv against the Tel-Aviv Municipality’s refusal to grant them a discount on municipal property tax for 2002 and to instruct the Minister of the Interior to enact a regulation granting such a discount (Hotels – Miscellaneous).

Added: Small Claims Court in Jerusalem judgment dated July 29, 2004, ruling that BUDGET Rent-a Car rental company should reverse charges it made to its client for under carriage damage and for extra rental hours (Car rental -Judgments)

Added: Decision of a small claims court in Hadera (from 1996) dismissing in limine a suit against an Israeli rental agency based on a jurisdiction stipulation that appeared in a German rental contract, which provided that the court in Munich has the jurisdiction to hear claims in accordance with the contract (Car Rental - Judgments).

Added: Tel Aviv Regional Labor Tribunal judgment dated April 11, 2005 which set forth that Arkia Israeli Airlines pilot, who resigned from his position as a pilot in its Boeing 757 fleet has to compensate Arkia for the expenses incurred to Arkia in his training as a Boeing 757 pilot  (Aviation – Judgment – Employment Conditions) .

Added: Supreme Court judgment that changed the common ruling regarding leave for service of a third party notice abroad. The judgment provided that a foreign “defendant” in a third party notice can be considered an essential or proper litigant for the purpose of an action that is conducted in Israel, even if that same notice does not include the ”defendant” who was duly served in Israel in addition to the foreign "defendant" (Vacation Clubs – Service).

Added: Judgment of the Tel-Aviv Small Claims Court which analyzed the duty of proper disclosure of organized tours and criticized the statement of defense of the organized tours, asserting that: “… even if there is a “trend”, which the defendant argued exists (relying inter alia on a court judgment) among travelers of filing false claims in the hope of using them as a means for financing their next trip, this does not justify a corresponding “trend” of using this argument as a defense against every claim pertaining to vacation trips. Added: Decision of the Tel-Aviv Small Claims Court dismissing a plea of a travel agency that the customer could have checked on the Internet the hotel accommodations that was sold to him by the travel agency, and compensated travelers for being lodged in a hotel without air-conditioning when the customer requested a hotel with air-conditioning (Travel Agencies  - Judgments).

Added: Supreme Court decision dated February 6, 2005 which maintained the decision of the Tel-Aviv District Court not to dismiss in limine a class action against Clalit Health Services. It was contended in the class action that Clalit Health Services must allow all its insured parties, without any restriction, to purchase overseas travel insurance which is provided by Clal Insurance Ltd. (hereinafter - Clal Insurance), since Clalit Health Services published it as a supplementary health service under the provisions of section 10 of the State Health Insurance Law, 5754-1994)  .

Added: Tel-Aviv Magistrates Court judgment dated September 2, 2004 regarding a delay on KLM flights. The court held that a technical failure delaying the departure of a flight constitutes force majeure, but maintained that the airline did not prove that it had adopted all precautions to avoid damage by notifying the passenger of the delay (Aviation – Judgments – Delay; Aviation – Judgments – Prevention).
