mobility difficulties, the supplier has a "minimum duty of care to

plaintiff with her specific handicap and that all the facilities

Court of January 29, 2007 rejecting a claim of a passenger against Delta
Airlines for a delay in its flight from
the U.S. to Israel. It accepted the company's plea that the reason for the delay
was a fire in the engine and a shortage of seats owing to the peak summer
season. The airline was
released from liability in accordance with
section 20(1) of the 1929 Warsaw Convention.
The court further held maintained that although the terms in section 9 of the
transport conditions in the airline ticket are sweeping:
"There is no disputing that the contractual liability of the defendant is
subject to the fact that unforeseen technical failures will not disrupt the
